Exemption from Building Consent

The Building Act 2004 allows for some types of building work to be carried out without obtaining a building consent. Some building work is automatically exempted by the Building Act 2004. For other building work, the council can decide to exempt the building work under Schedule 1(2) of the Building Act.

Steps in this form

Project

  • Application type captures general information about pre-application meetings, previous consents, staged construction and design

  • Project description sets general information about the scope of the planned building work and reason for the project.

Property

  • Legal description captures details of ownership of the property and legal description of the land, including regarding contaminants in the soil

  • Buildings contains detailed questions about the structures affected by the building work.

  • Building code compliance describes how the building work will comply with the clauses of the building code, such as structural stability, durability, protection from fire, access, moisture control, services and facilities, and energy efficiency.

  • Compliance schedule identifies the building’s specified systems and the inspection, maintenance and reporting procedures needed to keep them in good order.

People and Roles

  • People and roles adds participants, identifies those who have mandatory roles like Agent, Registered Owner and Invoice Payer, and manages the level of access they have to an application.

Note:  Restricted building work (RBW) is now captured through a question on the Project description step of the form. To record the LBPs carrying out or supervising RBW, please ensure you add the LBPs as participants in the People and roles step, including adding their license details. You can search the LBP register to select an existing LBP and the system populates their license information.
